How to deal with car clamping under MCST
The clamping of car is
usually found under the bylaw in an estate.
It must be pass as bylaw before it can be enforced.
Guideline:

Follow the Standard
Operating Procedure (SOP)/Key
Performance Indicator (KPI)

Provide warning before
and after clamping
·
Allows appeal for
clamping
·
Clamping happy hurts SP
relation
·
Only clamp when the car
is park where it is causing inconvenience and affecting the whole estate.
Example: park in the middle of the road.
Park double parking space.
Something too obvious and irresponsible parking.
Additional Note:
Clamping appeal should
be done by a workgroup setup if it happen frequently and have them submit their
recommendation so that it won’t waste too much time in the monthly council
meeting.
Clamping may be adapted
by each council in the govern estates; however, it may violate the right of the
SP if clamping is not done appropriately.
The best way to
challenge this if you fail at the appeal then another option is to take it
directly to Strata-title
Board (STB). It has never been
proven that any estate can legally setup by law that allow clamping in an
estates. This by law on clamping maybe
in violation of the legal right of SP but can only proven once it is challenge
in STB. It will cost you only $500 to present this
case directly in Singapore.
